Implementation of safety production management on horizontal properties There are many concerns surrounding health and safety issues in working on horizontal properties. Generally, they range from "This doesn't apply here," "I don't know what it is," or "It's just another state requirement." However, there is a fundamental principle in Colombian law. Specifically, pointing out ignorance of the law does not absolve one from responsibility. In this context, it is important to clarify how to implement an effective occupational health and safety management system (SG-SST). In this article, we explain how to do this, the responsibilities of co-ownership, and more. Who is responsible for job safety in co-ownership? Condominiums and shared ownership require workers to function properly. This involves taking on certain labor obligations, or if that's not possible, verifying that your contractor does the same. In this sense, horizontal property is a civil, non-profit legal entity. However, it does not provide special treatment and does not provide exemptions from labor standards such as workplace safety. Therefore, workers’ rights must be fully guaranteed, including the implementation of the SG-SST; corresponding to all employers, whether public or private, who conduct recruitment in accordance with the different methods prescribed by regulations.
Each lateral property must then implement an occupational health and safety system (SG-STT). In this sense, the resolution establishes two groups applicable to joint ownership: Micro-enterprises All companies, employers and contractors that meet all these conditions are: Ten (10) or fewer workers. Classified as risk I, II or III. In addition, they must meet the following minimum standards: Designate a dedicated person to design the occupational safety and health management system. Join the comprehensive social security system. Provide workers with occupational safety and health training. Design your annual work plan.
Undertake an occupational medicine evaluation. Identify hazards through risk assessment and evaluation. Develop prevention and control measures for identified hazards/risks. In addition to the criteria described for microenterprises, they must meet the following minimum criteria: Allocate resources to SG-SST. COPASST and the Labor Coexistence Committee are established and operational. Develop an occupational health and safety policy. Maintain archives and document retention for SG-SST. Determine the sociodemographic characteristics of the working population and diagnose their health conditions. Conduct occupational medicine and health prevention and promotion activities. Follow work restrictions and medical advice. Report work accidents and occupational diseases. Investigate incidents, workplace accidents and illnesses when they are diagnosed as work-related. Perform regular maintenance of facilities, equipment, machines and tools. Provide personal protective elements and train in their proper use.
